How to Order

The following are the terms and conditions ("Terms and Conditions") for the sale of products by Amwav Technology Ltd.("Amwav") to Amwav's customers ("Customers"). Please read this agreement carefully. Any different or additional terms set forth in Customer's purchase order or similar communication are objected to by and shall not be binding for Amwav unless a separate agreement has been signed by an authorized officer of the company. By placing an order for products from the company, or by accepting delivery of the products described on the applicable packing slip, bill of lading, and/or invoice received with the products, you agree to be bound by and accept these terms and conditions of sale.


Subject to the provisions herein, all quotes submitted are firm for sixty (60) days from the date of the quotation unless indicated differently on the face of the quotation. Alterations or changes to quotations after sixty (60) days may be made at the discretion of Amwav without notice.

If Customer fails to take delivery of the quantity of goods upon which a quantity discount price, if any, is based, Customer will be charged an amount based upon the quantity actually delivered  and upon the quantity pricing schedule in effect at the time the order was placed. Such charges shall be in addition to any cancellation charges.

Prices apply only if the quantity ordered is shipped within twelve (12) months and shipments are scheduled no more than twelve (12) months from the date Amwav received Customer’s order. Otherwise, Amwav’s standard prices in effect on the date of receipt by Customer of the quantity actually shipped shall apply, and Customer shall pay the difference in price, if any.

2International Taxes and Duties

Prices do not include any taxes, Customer is responsible for duties, taxes or customs fees imposed in the Customer’s country.

3. How to Order

When placing an order, please state both the catalog number and description. If any custom features are required, please contact our Application Engineers and a special part number will be assigned.

4. Payment Terms

Payments can be made in U.S. Dollars or Euro, and are net 30 days for customers with established accounts. International orders are prepaid in advance of shipment and require a minimum deposit of 30% at order inception. Orders greater than $ 10,000.00 also require a minimum deposit of 30% at order inception.

5. Delivery and Title

Shipping or freight charges and insurance will be paid by Customer. All international sales are made FOB Chengdu, China, and delivery of the products to the carrier will constitute delivery to Customer and title and risk of loss or damage will pass to Customer

Amwav will make reasonable efforts to initiate shipment and schedule delivery as close as possible to Customer's requested delivery date(s). Customer acknowledges that delivery dates provided by Amwav are estimates only and that Amwav will not be liable for failure to deliver on such dates.

Preferred Methods of Shipment:

a. UPS International Services: UPS Worldwide Expedited (3-5 Days U.S.), UPS Express.

b. DHL Express


6. Warranty

Amwav warrants products of its manufacture to be free from defects in material and workmanship under conditions of normal use. All products are covered by a limited warranty for a period of one (1) year from the date of shipment when purchased from Amwav. If, within one year of delivery (as determined by the manufacturing date code), any Amwav product is found to be defective, Amwav shall, after prepaid return by the owner, at its option, repair or replace the defective item. Further, no warranty will apply if the Product has been subjected to disassembly, misuse, neglect, accident, or modification, or has been soldered or altered in any way or subjected to conditions exceeding the applicable specifications or ratings. Amwav reserves the right to make design changes, without notice, on any of its products without any obligation to make the same or similar changes to items previously purchased. In no event does Amwav assume liability for installation labor or for consequential damages. This warranty is the extent of the obligation or liability assumed by Amwav, with respect to products, and no other warranty or guarantee is either expressed or implied

7. Past Warranty Period

Amwav products that have exceeded the 1 year warranty period and are returned to the factory for repair shall be repaired or replaced at a determined cost billed to the Customer. Customer shall receive an estimate of the repair cost prior to effecting repairs.

8. Cancellation, Rescheduling, Returns and Modifications

Any request for order cancellation, rescheduling, return or modification must be made in writing, and such action must be approved in writing by Amwav. Such requests are subject to processing charges as outlined in paragraph 8a.

8a. Cancellation Charges:

For standard catalog items, cancelled orders and/or returned items are subject to a 30% restocking charge (of sale price) or a $100.00 minimum charge per item (whichever is greater). This charge may vary at the discretion of Amwav depending on the amount of materials on order at the time of cancellation and the resulting cancellation charges from our supply chain.  

For non-standard products, built to Customer’s specifications or pursuant to Amwav’s design, Customer shall have no right to cancel or reschedule the delivery of any non-standard products. All sales are final for non-catalog items, which are therefore Non-Cancelable/Non-Refundable(NCNR/custom) .

8b. Returns

All returned items are inspected upon receipt for quantity, physical condition and electrical function. All claims for shortage must be made within thirty (30) days of date of shipment from Amwav. Title to goods passes to the Customer upon delivery to carrier, and risk of loss or damage shall thereafter rest with the Customer. The Customer must make claims for damage or loss while material is in transit. Returned products will not be accepted without a Return Material Authorization (RMA) number. This number may be obtained by calling our quality assurance department. Freight charges for unauhorized returned material are the responsibility of the Customer. In addition, an evaluation fee will be charged to the Customer to cover inspection and testing costs for any item returned by the Customer that is found to be within specifications and/or otherwise deemed to be within the terms of the original purchase.
